The "third sex" recognized in Germany

A pioneer in Europe, Germany is the first country to open the "other" sex status to civil status.


On Friday 14 December, late in the evening, the Bundestag (German Parliament) changed the gender-related box of the German Civil Registry. The Germans will no longer be forced to declare themselves feminine or masculine, but may have access to a third option: "various", according to Radio France Internationale .


EXIT A MALE / FEMALE BINARY SYSTEM

Germany, which has already been able since 2013 to evade the sex field of the Civil Registry by opting for an empty space, is the first country in Europe to open a third status, behind Nepal, Australia or New Zealand where this measure is already in place.
The RFI website reports the case that caused this change. The story of a person named Vanya, born in 1989 and registered to the female sex. Later, she realizes that her ovaries are not working and that she lacks a chromosome to determine her gender with certainty. His request ? To be registered in the civil state for what it is: a " third sex ". Her request rejected by the administration, she leads the case before the Constitutional Court.

MEDICAL EVIDENCE FOR A THIRD GENDER

Since this case, the Constitutional Court has condemned the existing law in Germany and forced the country to find a better solution by the end of the year. This is done, the Bundestag now allows transgender people or not recognizing any gender a real option, named for the civil status.

But this law provides, to access this option "various", to provide medical evidence. LGBT + associations campaign for a purely personal choice, identity and without physiological justification. If this decision is a historic step forward, the fight continues.
